誰會被盯上：不只是「高風險」系統

很多人以為EU AI Act只管醫療、金融這類高風險系統，那個門檻其實要到2027年12月才全面生效。但現在已生效的第50條透明度義務範圍更廣：

聊天機器人、客服Bot：須讓使用者知道在跟AI互動，不能裝成真人
深偽（deepfake）影片、圖片：AI生成或竄改的內容要清楚標示
談公共議題的AI生成文字：新聞、時事類文章需揭露AI參與程度
就算沒自己訓練模型，只要「整合」或「實質修改」別人的基礎模型給歐盟使用者用，一樣要負責

罰款有多重：最高7%全球營收

EU AI Act最重一級可罰3,500萬歐元或全球年營收7%，兩者取高。主管機關還能要求下架、限制使用甚至叫停系統。9月稽核查的是有沒有完整技術文件、風險評估跟人工監督紀錄——拿不出資料，比罰款本身更麻煩。

現在該做什麼

不用等2027年大限，現在就能做三件事：

盤點AI系統清單：公司內部有哪些會跟使用者互動的AI功能，先列出來
補上揭露標示：聊天機器人加一句「你正在與AI對話」，成本很低，很多產品卻沒做
留存文件：模型版本、訓練資料來源、風險評估，稽核來時要拿得出來

跟美國目前偏鬆散的態度相比，EU AI Act是唯一真的在動手稽核的框架。產品有歐盟用戶，這不是「以後再說」的事。這次評測的不是一款工具，而是一條規則——但道理一樣：好不好用，試了才知道，合不合規，也是查了才知道。

🇺🇸 EU AI Act Review: AI Disclosure Rules Now in Force

The EU AI Act's transparency rules took effect on August 2, 2026, and starting this September, the EU AI Office and market surveillance authorities across 24 member states have launched their first wave of compliance audits. If your product has a chatbot, generates content, or interacts with users in any AI-driven way, this is what you actually need to know right now — not the panic version, the checklist version.

Who's Affected: Not Just "High-Risk" Systems

Most people assume the EU AI Act only targets high-risk categories like healthcare and finance — that full enforcement doesn't kick in until December 2, 2027. But the transparency obligations under Article 50, live right now, apply much more broadly, to almost anything that talks to a user:

Chatbots and customer-service bots: users must be told they are talking to AI, not a human
AI-generated or manipulated content: deepfake images and video need clear labeling
AI-generated text on public affairs: news and current-events content must disclose AI involvement
Even without training the model yourself, integrating or materially modifying someone else's foundation model for EU users still puts the obligation on you

The Penalties: Up to 7% of Global Revenue

The EU AI Act's top penalty tier reaches €35 million or 7% of worldwide annual turnover, whichever is higher. Fines aren't the only risk — regulators can order corrective action, restrict deployment, or pull a system from the market entirely. The audits starting this September check whether companies actually have the paperwork: technical documentation, risk assessments, human-oversight logs. Missing the paperwork is often worse than the fine itself.

What To Do Now

No need to wait for the 2027 high-risk deadline. Three things worth doing immediately:

Inventory your AI systems: list every AI feature that touches a user, internally, before an audit does it for you
Add disclosure labels: a simple "you're talking to AI" notice on chatbots, watermarks or tags on generated content — cheap to add, and plenty of products still skip it
Keep documentation: model versions, training data sources, risk assessments — have it ready before an auditor asks

Compared to the US, still leaning toward a lighter-touch, state-by-state approach, the EU AI Act is the only framework actually running audits right now. If your product has EU users, this isn't a deal-with-it-later problem. This time the review isn't of a tool — it's of a rule. Same motto applies: you won't know if it works until you try it — and you won't know if you're compliant until someone checks.
