🇹🇼 EU AI Act評測:8月2日上路但高風險規定延至2027

EU AI Act(歐盟人工智慧法案)原訂高風險系統義務在2026年8月2日全面上路,但今年7月歐盟通過的《Digital Omnibus》法案,把大部分高風險規定的期限延到2027年12月2日,部分產品內建AI系統甚至延到2028年8月。也就是說,如果這幾天你在網路上看到「EU AI Act今天正式生效」的新聞,只對了一半——真正立刻生效的,其實只有透明度和AI素養義務。

8月2日真正上路的是什麼

先講清楚實際狀況。EU AI Act在2026年8月2日確實有東西上路,但不是外界熱議的「高風險系統」那一塊,而是:

  • Article 50 透明度義務:AI生成內容(聊天機器人、deepfake、AI生成文字/圖片/影音)必須明確標示,讓使用者知道自己在跟AI互動。
  • Article 4 AI素養義務:企業必須確保員工具備足夠的AI知識,才能安全操作AI系統。
  • 已經上市的舊系統暫時排除在Article 50(2)之外,但2026年12月2日之後也要補上。

高風險規定延到什麼時候

原本外界最擔心的就業、信用評分、教育、關鍵基礎設施等高風險AI系統合規要求(含符合性評估、CE標章),Digital Omnibus把期限從2026年8月2日延後到:

  • Annex III獨立高風險系統:延到2027年12月2日
  • Annex I產品內建AI系統(如醫療器材、汽車):延到2028年8月2日

換句話說,企業原本要在8月趕工的合規評估、風險管理系統,現在多了一年以上的緩衝期。但這不代表可以放著不管——不合規的罰則依然很重:一般違規最高3500萬歐元或全球營收7%,高風險/GPAI相關違規最高1500萬歐元或營收3%,兩者取高者。

對企業實際上代表什麼

如果你的公司在歐盟境內營運、或產品有歐盟用戶,現在該做的不是等到2027年才動作,而是:

  • 先確認自己的AI功能是否涉及Article 50的透明度標示(聊天機器人、生成內容)
  • 盤點內部誰在用AI工具,補上基本的AI素養訓練
  • 高風險系統合規評估可以慢慢規劃,但不建議完全擱置,因為2027年12月轉眼就到

整體來看,EU AI Act的實際上路節奏比新聞標題溫和很多,這也是歐盟在全球AI競爭壓力下對企業鬆綁的訊號。但監理方向沒有變,只是給了更多準備時間。

🇺🇸 EU AI Act Review: High-Risk Rules Delayed to Dec 2027

The EU AI Act was supposed to bring its toughest rules — high-risk AI system obligations — into force on August 2, 2026. But the EU Digital Omnibus, signed into law in July, pushed most of those deadlines to December 2027 (and August 2028 for embedded products). If you saw headlines saying "EU AI Act takes effect today," that is only half true — what actually kicked in this week is narrower than advertised.

What Actually Went Live on August 2

Here is what is real as of August 2, 2026 under the EU AI Act:

  • Article 50 transparency obligations: chatbots, deepfakes, and AI-generated text/image/audio must be clearly disclosed to users.
  • Article 4 AI literacy duty: companies must ensure staff have enough AI knowledge to operate systems safely.
  • Systems already on the market get a temporary exemption from Article 50(2), but that exemption ends December 2, 2026.

High-Risk Rules: Pushed to 2027 and 2028

The obligations everyone was actually worried about — for AI in hiring, credit scoring, education, and critical infrastructure — got real breathing room. The Digital Omnibus moved:

  • Annex III standalone high-risk systems: to December 2, 2027
  • Annex I embedded AI (medical devices, cars): to August 2, 2028

That is over a year of extra runway for conformity assessments and CE marking. Penalties have not softened, though: up to €35M or 7% of global revenue for general violations, and up to €15M or 3% for high-risk/GPAI non-compliance — whichever is higher.

What This Actually Means for You

If your company operates in the EU or serves EU users, do not wait until 2027 to act. Do this now:

  • Check whether your AI features trigger Article 50 disclosure (chatbots, generative content)
  • Inventory who is using AI tools internally and run basic AI literacy training
  • Start planning high-risk compliance work — December 2027 will arrive faster than it sounds

The bottom line: the EU AI Act rollout is much gentler than the headlines suggested, a sign Brussels is easing pressure on companies amid global AI competition. The regulatory direction has not changed — just the timeline.
