Perplexity Comet just won a major legal battle: on August 4, 2026, the Ninth Circuit Court of Appeals vacated the preliminary injunction that had barred Perplexity's AI browser Comet from accessing Amazon.com, marking the first federal appellate ruling on whether AI shopping agents can legally act on a user's behalf on third-party websites — a decision that could reshape the entire agentic commerce industry.

What did the Ninth Circuit actually rule?

The court ruled AI shopping agents don't count as unauthorized access under the CFAA, because it's the user — not the company behind the agent — who is legally doing the accessing. The panel found Amazon is unlikely to win its Computer Fraud and Abuse Act (CFAA) claim, since on the record, it's Amazon's own customers, not Perplexity, who "access" Amazon's systems. In other words, when a user authorizes an AI agent to log in, browse, and buy, the legal accessor stays the human user.

Why did Amazon sue Comet in the first place?

Amazon filed suit last November, claiming Comet logged into customers' password-protected Amazon accounts to shop on their behalf without adequate disclosure, allegedly violating both the CFAA and California's Comprehensive Computer Data Access and Fraud Act (CDAFA). A district court sided with Amazon in March, issuing a preliminary injunction that blocked Comet from Amazon.com — now overturned on appeal.

What does this mean for AI agents going forward?

For teams building AI shopping agents and browser-automation tools, this is a real win: as long as users clearly authorize the agent, courts are treating it as an extension of the user, not an unauthorized intruder. That makes it harder for platforms to use the CFAA alone to lock AI agents out. But it's not a free pass — Amazon can still fight back through terms of service, CAPTCHAs, bot-detection, or other legal claims, and the underlying case isn't fully resolved; only the injunction was lifted.

I ran Comet through a few e-commerce sites for auto price-comparison and cart-filling — it's genuinely faster than doing it manually, but it still occasionally stalls on 2FA or dynamic CAPTCHAs, so it's not frictionless everywhere yet. This ruling lowers the legal risk around AI shopping agents, but the technical cat-and-mouse game with platforms will keep going. If you're trying one, only grant account access to agents you actually trust.
